Privacy policy

MH Gallery Co., Ltd. (hereinafter referred to as "the Company") has established the following privacy policy (hereinafter referred to as "this Policy") regarding the handling of users' personal information in the services provided on this website (hereinafter referred to as "the Service").

Article 1 (Personal Information)

"Personal Information" refers to information as defined in the Personal Information Protection Law, which pertains to a living individual and can identify a specific individual based on the name, date of birth, address, telephone number, contact information, or other descriptions contained in such information. It also includes data related to appearance, fingerprints, voiceprints, and health insurance policyholder numbers, which can identify a specific individual when used alone (hereinafter referred to as "Personal Identifiable Information").

Article 2 (Method of Collecting Personal Information)

The Company may ask users to provide personal information such as their name, date of birth, address, telephone number, email address, bank account number, credit card number, and driver's license number when registering for the Service. In addition, the Company may collect transaction records and payment information, including users' personal information, from the Company's partners (including information providers, advertisers, and ad distribution destinations; hereinafter referred to as "Partners").

Article 3 (Purpose of Collecting and Using Personal Information)

The purposes for which the Company collects and uses personal information are as follows:

1. To provide and operate the Service.

2. To respond to inquiries from users (including verifying the user's identity).

3. To send emails about new features, updates, campaigns, and other services provided by the Company.

4. To contact users when necessary for maintenance or important notifications.

5. To identify users who violate the Terms of Use or attempt to use the Service for fraudulent or improper purposes, and to refuse their use.

6. To allow users to view and modify their registered information, and to view their usage status.

7. To charge users for paid services.

8.To achieve any purposes related to the above.

Article 4 (Change of Purpose of Use)

1. The Company may change the purpose of use of personal information only when it is reasonably deemed relevant to the original purpose of use.

2. In the event of a change in the purpose of use, the Company will notify users or publicly announce the new purpose by the prescribed method.

Article 5 (Provision of Personal Information to Third Parties)

The Company will not provide personal information to third parties without obtaining the user's prior consent, except in the following cases or when permitted by the Personal Information Protection Law or other applicable laws and regulations:

1.When it is necessary to protect a person’s life, body, or property, and it is difficult to obtain the individual's consent.

2.When it is particularly necessary for the improvement of public health or the promotion of sound development of children, and it is difficult to obtain the individual's consent.

3.When it is necessary to cooperate with a national or local government agency or an entity entrusted by such government agency to perform duties prescribed by law, and obtaining the individual's consent could impede the performance of those duties.

4.When the following has been previously announced or disclosed, and the Company has submitted the necessary notification to the Personal Information Protection Commission:

・The inclusion of provision to third parties in the purpose of use.

・The items of data provided to third parties.

・The method or means of providing the data to third parties.

・The right of the individual to request the cessation of the provision of personal information to third parties.

・The method of accepting requests from the individual

However, in the following cases, the recipient of personal information will not be considered a third party:

1.When the Company outsources the handling of personal information within the scope necessary to achieve the purpose of use.

2.When personal information is provided as part of a business succession due to mergers or other reasons.

3.When personal information is used jointly with a specific party, and the individual has been notified in advance of the fact of joint use, the items of personal information to be used jointly, the scope of those sharing the information, the purpose of use by those sharing the information, and the name or title of the person responsible for managing the information.

Article 6 (Disclosure of Personal Information)

Upon request from the individual, the Company will promptly disclose their personal information. However, in the event that disclosure falls under any of the following categories, the Company may withhold some or all of the information, and if a decision is made not to disclose, the Company will notify the individual promptly. A fee of ¥1,000 per request will be charged for the disclosure of personal information:

When disclosure is likely to harm the life, body, property, or other rights or interests of the individual or a third party.

When disclosure is likely to significantly impede the proper execution of the Company's business.

When disclosure violates other laws and regulations.

Notwithstanding the above, the Company generally does not disclose information other than personal information, such as historical or characteristic information.

Article 7 (Correction and Deletion of Personal Information)

1.If a user's personal information held by the Company is incorrect, the user may request the correction, addition, or deletion of the personal information (hereinafter referred to as "Corrections") through procedures established by the Company.

2.If the Company deems it necessary to respond to the user's request as mentioned in the previous paragraph, the Company shall promptly make the Corrections to the personal information.

3.The Company shall promptly notify the user when the Corrections have been made, or if the decision is made not to make the Corrections, in accordance with the provisions of the previous paragraph.

Article 8 (Suspension of Use of Personal Information)

1.If the Company is requested by the individual to suspend the use or delete their personal information (hereinafter referred to as "Suspension of Use") on the grounds that it is being handled beyond the scope of the intended purpose or was obtained through improper means, the Company shall promptly conduct the necessary investigation.

2.Based on the results of the investigation mentioned in the previous paragraph, if the Company deems it necessary to comply with the request, it shall promptly implement the Suspension of Use.

3.The Company shall promptly notify the user when the Suspension of Use has been carried out, or if the decision is made not to suspend use, in accordance with the provisions of the previous paragraph.

4.Notwithstanding the previous two paragraphs, if the Suspension of Use requires a large amount of cost or is otherwise difficult to implement, and if alternative measures can be taken to protect the user's rights and interests, the Company shall take such alternative measures.

Article 9 (Changes to the Privacy Policy)

The content of this Policy may be changed without notifying users, except as otherwise provided by law or in this Policy. Unless otherwise specified by the Company, the revised Privacy Policy will become effective when posted on this website.
